THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.12036 of 2015 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the second respondent in not passing the order on the stay application filed by the petitioner against the order, dated 05.02.2015, passed by the third respondent in case No.CSB75/2014, confirming the order of the fourth respondent, whereby the petitioner's fair price shop authorization was cancelled as illegal and arbitrary and against the principles of natural justice. Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner is an authorized fair price shop dealer, that the fourth respondent has issued show cause notice alleging that the petitioner has been drawing commodities on the dead person and that the petitioner has not been maintaining the stock register properly, that the petitioner has given explanation to the said show cause notice and that without conducting any enquiry and without considering the explanation given by the petitioner, the fourth respondent cancelled the authorization of the petitioner. The petitioner has preferred appeal against the said order of the fourth respondent and appeal is dismissed. Again, the petitioner has preferred revision before the second respondent along with the stay application. The respondents have not passed any orders till now on the revision petition and the stay application. In view of the above, this writ petition is disposed of with a direction to the second respondent to dispose of the revision along with the stay application filed by the petitioner within a period of fifteen

(15) days from the date of receipt of copy of this order. The writ petition is accordingly disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any shall also stand disposed of.
