HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.766 of 2014 ORDER:

This petition is filed to withdraw O.P.No.1545 of 2014 from the file of Family Court, L.B.Nagar, Hyderabad, and transfer the same to Family Court, Chittoor District.

2. Wife filed this petition and according to her affidavit, her marriage was performed with respondent on 16.03.2006 at Chittoor and she was blessed with a male child, thereafter respondent started harassing her on one pretext or the other and having suffered with physical and mental agony in the hands of respondent and his parents, she came back to her parent's house. She stated that husband herein earlier filed O.P.No.567 of 2011 for dissolution of marriage, but the same was withdrawn. Again he filed O.P.No.1545 of 2014 for dissolution of marriage before Family Court, L.B.Nagar, Hyderabad. She stated that she has no source of income and she is purely dependent on her parents and it is difficult for her to travel from Tirupati to Hyderabad along with the child to defend O.P.No.1545 of 2014. She further stated that she has no relatives at Hyderabad and she cannot stay at Hyderabad being a lady, for these reasons, she prayed for transfer of O.P.No.1545 of 2014 from Hyderabad to Chittoor.

3. Respondent in spite of service of notice neither appeared in person nor through any Advocate.

4. Heard advocate for petitioner.

5. I have perused the material papers filed along with transfer C.M.P. Considering the reasons stated in the affidavit and also considering the convenience of wife, O.P.No.1545 of 2014 is withdrawn from Family Court, L.B.Nagar, Ranga Reddy and transferred to Family Court, Tirupati, Chittoor district, for disposal in accordance with law.

6. For these reasons, transfer C.M.P. is ordered. No costs.

7. Miscellaneous Petitions pending, if any, shall stand dismissed.
