HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.43347 of 2016 ORDER:
This writ petition is filed seeking a direction to the 2nd respondent not to interfere with the possession and title of the petitioner and his family members over the land to an extent of Ac.2.27 gts., in Sy.No.215/AA of Janawada Village, Shankerpally Mandal, Mirzaguda G.P., R.R.District.
Heard and perused the material available on record. The grievance of the petitioner is that without there being any complaint, the 2nd respondent along with his staff came to the site of the petitioner on 8.12.2016 and tried to interfere with his possession at the influence of some persons, who are trying to encroach the said property.
Learned Assistant Government Pleader for Home submitted that the 2nd respondent is not intending to interfere with the civil disputes.
Considering the circumstances of the case, without expressing any opinion on merits, the Writ Petition is disposed of directing the 2nd respondent not to interfere with the possession of the petitioner over the above described property. However, this order will not stand in the way of the 2nd respondent to register a case, if any complaint is lodged against the petitioner disclosing cognizable offence. No costs.
