THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.35323 of 2018 O R D E R:

When the matter is taken up, it is submitted by the learned Standing Counsel for the respondent Municipality Sri Md.Saleem, that the municipality already issued notice to the person in occupation of the subject property and will issue fresh notice to the petitioner herein, who claims to be the owner of the property, and it is open for the petitioner to submit explanation for the same.

Recording the said submission of the learned Standing Counsel, the writ petition is disposed of, directing the respondent Municipality to serve notice on the petitioner herein and after receipt of notice the petitioner herein shall file explanation within a period of two weeks from the date of receipt of such notice and thereafter it is open for the respondents herein to take action strictly in accordance with law. Till then, there shall be no coercive action with regard to the subject property. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
