HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Civil Revision Petition No. 4256 of 2013 Order:

The respondent herein filed OS No.156 of 2011 on the file of the Senior Civil Judge, Peddapalli, seeking permanent injunction in respect of the land to an extent of Ac.200 in Survey No.313, situated at Vennampalli village of Srirampur Mandal, Karimnagar District. He also filed IA No.591 of 2011 seeking temporary injunction. The said application for temporary injunction was dismissed and the ex parte injunction granted earlier was vacated, by an order dated 31.07.2012. Challenging the same, the respondent herein preferred CMA No.55 of 2012 before the Judge, Family Court-cum-Additional District and Sessions Judge, Karimnagar, who set aside the order in IA No.591 of 2011 and allowed CMA No.55 of 2012, by an order dated 19.08.2013. When the said order was challenged by the petitioners herein, this Court, by an order, dated 04.10.2013, directed both the parties to maintain status quo in respect of the said property. The said order is in operation till today.

2. In view of the order of status quo, which has been in operation, this Court is not inclined to express any opinion with regard to merits of the case. As the suit is of the year 2011 and is pending consideration before the learned Senior Civil Judge, Peddapalli, the learned Senior Civil Judge, Peddapalli, is directed to dispose of the said suit OS No.156 of 2011 as expeditiously as possible, but not later than 30.09.2016, by giving due opportunity to both the parties and uninfluenced by any of the observations made by the lower appellate Court in CMA No.55 of 2012. It is needless to observe that the order of status quo shall continue till disposal of the suit.

3. Accordingly, the Civil Revision Petition is disposed of. However, in the circumstances, no costs.

4 . As a sequel thereto, the miscellaneous petitions, if any, pending in this Civil Revision Petition shall stand closed.
