This Criminal Petition is filed for grant of pre-arrest bail to the petitioner who is arrayed as accused in Crime No.102 of 2025 before the Rajapet Police Station, registered for the offence punishable under Section 194 of BNSS which was later altered to Section 108 of BNS.

The brief facts of the case of prosecution is that the brother of deceased lodged a report stating that the deceased committed

suicide by hanging himself and the petitioner is under his suspicion for the same.

Heard Sri N.Harinadh, learned counsel for petitioner, and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for petitioner submitted that the petitioner is no way connected to the alleged offence and merely a dispute between the petitioner and deceased does not attract abatement to committing suicide as there is no clarity in the suicide note. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this Criminal Petition. 5.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner stating that the allegations leveled against the petitioner are serious and there were disputes between the petitioner and deceased which resulted in committing suicide. That apart, the investigation in the case is not yet completed. Therefore, he prayed the Court to dismiss the criminal petition.

Having considered the rival submissions, it is noted that though it is averred that there was dispute between the petitioner

and deceased, it is seen that no such date is mentioned in the complaint, nor in the statements of witnesses, so as to connect the petitioner with the suicide of deceased. Therefore, this Court deems it appropriate to grant anticipatory bail to the petitioner, subject to the following conditions.:

i.

The petitioner shall surrender before the Station House Officer, Rajapet Police Station within two weeks from today, and on such surrender, the said Station House Officer shall release the petitioner on bail on him executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for the like sum each.

ii.

The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Wednesday for a period of eight (8) weeks, for the purpose of investigation and thereafter, as and when required.

iii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of

BNSS and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. _______________ K. SUJANA, J Date : 09.12.2025 PT
