THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.7502 of 2016
ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioners/A1 to A4 seeking to quash the proceedings in Cr.No.305 of 2016 of Women Police Station, DD, CCS, Hyderabad, registered for the offences punishable under Sections 498-A, 406 IPC and under Sections 4 and 6 of Dowry Prohibition Act, against them.
2. Heard learned counsel for the petitioners/A1 to A4 and learned Additional Public Prosecutor representing the State.
3. It is alleged in the complaint that A1, at the instigation of A2 to A4, used to harass his wife i.e., 2nd respondent herein, physically and mentally by demanding additional dowry of Rs.5 lakhs and used to beat her mercilessly.
4. In view of the serious allegations in the complaint against the petitioners, the matter requires thorough investigation. Therefore, this Court is of the considered view that this is not a fit case to quash the impugned proceedings. However, considering the facts and circumstances of the case, the police concerned are directed to proceed with the investigation without arresting the petitioners/A2 to A4, except the first petitioner/A1. The petitioners/A2 to A4 are directed to appear before the investigating agency as and when required and cooperate with the investigating agency.
5. With the above direction, the Criminal Petition is disposed of in respect of petitioners/A2 to A4 and the Criminal Petition is dismissed against the first petitioner/A1. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
