Heard Mr. Butta Vijaya Bhaskar for petitioners and the Assistant Government Pleader (Revenue) for respondents 1 to 4.
2. The petitioners challenge the notice issued by 3rd respondent in Rc.E.201/ 2017 dated 17.01.2017. Mr. Butta Vijaya Bhaskar vehemently contends that the 3rd respondent has not conformed to the requirements of the A.P. Rights in Land and Pattadar Pass Books Act, 1971, and while entertaining the appeal, 5th respondent has not conformed to the requirements of sub-sec.5 read with Rule 21 of the A.P. Rights in Land and Pattadar Pass Books Rules, 1989.
3. I have perused the material available on record. The objection substantially is against the procedural aspects of the matter and this court has no doubt that the objections both on merits as well as on the preliminary, if are raised before the 3rd respondent, the 3rd respondent is under obligation to consider and decide them before taking up the enquiry, on merits of the matter. Liberty is accordingly given to the petitioners to raise all objections by enclosing a copy of this order.
3. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
