THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.14327 of 2015 ORDER:
This Criminal Petition is filed under Sec.438 of Cr.P.C. seeking anticipatory bail in the event of arrest of the petitioners/A.3 to A.5 in Cr.No.1067 of 2015 of Uppal Police Station, Cyberabad.
2. Heard both sides. Perused the record.
3. The petitioners/A.3 to A.5 are the sister, mother and father of A.1 respectively and A.1 is the husband of the deceased-Dharavath Shashikala.
The allegations against the petitioners are that they used to visit the matrimonial house of A.1 and deceased Shashikala and subjected to her physically and mentally, therefore, she committed suicide within four years of her marriage.
4. The contention of the petitioners are that they are nothing to do with the matrimonial life of the deceased and A.1 as they are not even staying with their house and that the 1st petitioner/A.3 is a student and 2nd and 3rd petitioners/A.4 and A.5 are aged parents of A.1.
5. In view of the nature of the offence alleged, I deem it appropriate to enlarge the petitioners/A.3 to A.5 on anticipatory bail.
6. Accordingly, this Criminal Petition is allowed. The petitioners/A.3 to A.5 are directed to surrender before the
III Metropolitan Magistrate at L.B.Nagar, Ranga Reddy District, within 15 days from today, and on such surrender, the learned Magistrate shall enlarge the petitioners/A.3 to A.5 on their executing a personal bond for a sum of Rs.25,000/- (Rupees twenty five thousand only) with two sureties each in a like sum to his satisfaction, subject to condition that they shall not interfere with the investigation, shall not intimidate or induce any of the witness acquainted with the facts of the case and shall cooperate with the Investigating Officer and shall make themselves available as and when required.
7. Pending miscellaneous applications, if any, shall stand closed in consequence.
