HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.1916 OF 2016 ORDER:

The writ petition is filed questioning the action of the 2nd respondent-Director in withholding the result of the petitioner with respect to the Entrance Examination conducted for admission into External Ph.D, M.S., M.P.Phil Research Programmes, 2015 conducted on 30.10.2015.

The respondents filed a detailed counter-affidavit alleging that the petitioner was involved in malpractice and as such he cannot seek any relief. It is also stated that the petitioner cannot seek the relief of declaration of results in view of the Rules framed by the Jawaharlal Nehru Technological University, Hyderabad. Having regard to the facts and circumstances of the case without going into the pleadings, contentions and merits of the respective parties and inasmuch as on date no decision has been taken by the competent authority of the University, the writ petition can be disposed of with a direction to the respondents to take a decision with respect to declaration of the results and communicate the same to the petitioner.

Further, the respondents cannot sit on the issue without taking a decision and thereby depriving whatever remedies the petitioner may otherwise have. On the other hand, the learned counsel for the respondents 1 and 2 submits that a decision for declaring the results of the petitioner would be taken within a period of one week from today. Recording the submission of the learned counsel for the respondents 1 and 2, the writ petition is closed directing the respondents to declare the results of the petitioner within a period of one weeks from today. No order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in this writ petition shall stand closed.
