R.Krishna Reddy, S/O Tirupathi Reddy, v. Greater Hyderabad Municipal Corporation,
HON'BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.18239 of 2011 Date: 05-06-2015 Between:
R. Krishna Reddy .... Petitioner AND Greater Hyderabad Municipal Corporation, Represented by its Commissioner, Kapra Circle and 2 others .... Respondents HON'BLE SRI JUSTICE A. RAJASHEKER REDDY Writ Petition No.18239 of 2011 ORDER:
This writ petition is filed for a mandamus declaring the action of the 1st respondent in sanctioning permission in favour of the 3rd respondent though the property covered by the impugned proceedings dated 19-08-2009 is open plot as illegal and arbitrary and for a consequential direction to the 1st respondent to withdraw and revoke the permission dated 19-08-2009 in respect of Plot No.233 forming part of Sy.No.159, 160, 232/262 situated at Karthikayanagar, Nacharam, Uppal, Ranga Reddy.
2. Though the matter is called on for hearing either in the morning session or the afternoon session, none appeared for the petitioner. Sri C. Raghu, learned counsel for the 3rd respondent stated that in pursuance of the impugned permission dated 19-08-2009, the 3rd respondent completed the construction and the suit O.S.No.1187 of 2009 filed by the petitioner against the vendors of the 3rd respondent was also dismissed on 27-04-2011 and that nothing remains to be adjudicated in the writ petition.
3. In view of the statement made by the learned counsel for the 3rd respondent that the construction has already been completed by the 3rd respondent pursuant to the impugned permission dated 19-08-2009 granted in his favour and since no interim order is granted in the writ petition, I do not see any merit in the writ petition. More so, the authorities would see only prima facie title to grant permission and they are not obligated to go into complicated questions of title while granting permission.
Accordingly, the writ petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
