ORDER:

This Writ Petition is filed for a Mandamus to declare notification in Rc.No.E/6076/2012, dated 08.11.2012, of respondent No.1, whereunder Fair Price Shop Nos.222/1 and 297/1 and 295/1 of Kothawada and Desaipeta Villages, respectively of Warangal District were reserved for B.C(B) (Women), OC and BC(A) respectively, as illegal and arbitrary. At the hearing, it has come out that though this Court has not granted interim order staying the further measures for appointment of dealers in respect of the above-mentioned fair price shops and instead, subjected the appointments to further orders, respondent No.1, for the reasons best known to him, has not proceeded with the selection and appointment of the dealers. Therefore, as the notification itself has become abortive due to non-appointment of

dealers, I find it unnecessary to adjudicate the Writ Petition on merits at this length of time. Instead, respondent No.1 is directed to work out the reservations afresh in terms of G.O.Ms.No.4, dated 19.02.2011 and complete the process of filling up the permanent vacancies of the above-mentioned fair price shops within three months from the date of receipt of a copy of this order.

Subject to the above directions, the Writ Petition is disposed of.

As a sequel to disposal of the Writ Petition, interim order, dated 22.11.2012, in WPMP.No.45314 of 2012 is vacated and WPMP.No.45314 of 2012 shall stand disposed of as infructuous. ________________________________ JUSTICE C.V.NAGARJUNA REDDY 08th October 2015 DR
