Bonda Ramesh Babu, v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.14323 OF 2017 ORDER:
The case of the petitioners is that they made a representation dated 17.10.2016 against the encroachment of lands admeasuring Ac.33.26 cents in Sy.No.29, 31/1, 35/1, 36/1, 32/2, 33/2, 34, 35/3, 43, 44, 45, 47, 48, 30, 30/1, 82 and 83 situated at Manuguluru Village, Mandavalli Mandal, Krishna District and the same is not being disposed of. Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioner submits that the land owned by the petitioners are purely private lands and inspite of representation made by the petitioners, the respondents are not protecting the same.
On the other hand, learned Assistant Government Pleader for Revenue submits that if there are any private disputes between the petitioners and the 3rd parties, they have to approach Civil Court and therefore, writ petition is not maintainable. In view of the above facts and circumstances, since the petitioners are claiming the subject lands as private lands, civil dispute between private parties has to be worked out in Civil Court. Accordingly, the writ petition is dismissed. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
