HON'BLE SRI JUSTICE S.V.BHATT CIVIL REVISION PETITION NO.4764 OF 2017 ORDER:

The petitioners challenge the order in I.A.No.202 of 2017 in O.S.No.523 of 2010 in the Court of the Principal Senior Civil Judge, Kurnool. The learned trial Judge through the order impugned in the revision permitted the amendment to include the following sentenc e.

" and entered into a memorandum of understanding dated 15.3.2010 regarding the commission payable to the second defendant".

Sri M.Vidya Sagar submits that in C.R.P.Nos.4469, 4493, 4548 and 4743 of 2017 filed against the orders in I.A.Nos.68 of 2017 in O.S.No.522 of 2010, 66 of 2016 in O.S.No.518 of 2010, 69 of 2017 and 67 of 2017 respectively in the Court of Additional Senior Civil Judge, Kurnool, this court has affirmed the applications filed for amendment. Therefore, this revision has to be allowed. The suits are admittedly pending in two different Courts. The reasons weighed with one learned Judge cannot and could not be a ground for setting aside the order passed in this Civil Revision Petition. The Civil Revision Petition is filed in O.S.No.523 of 2010. The Court below is directed to dispose of O.S.No.523 of 2010 as expeditiously as possible.

In stead of considering the prayer against amendment now granted by the trial court, by leaving all other objections available in this behalf to be raised and considered by the trial court, the Civil Revision Petition is dismissed. No order as to costs. Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
