CVNR,J & MSKJ,J WP.11014 of 2017 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.11014 of 2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus, directing the respondents to produce the petitioner's husband, by name, M.Shivaprasad, S/o.late M.Venkataiah (for short "the alleged detenu") before the Court and set him at liberty.

In the affidavit filed in support of the writ petition, the writ petitioner averred that though she has given report on 23.03.2017 complaining that since 19.03.2017 the alleged detenu was missing, respondent No.4 has not been taking any action. Respondent No.4 filed counter affidavit, wherein he has narrated various measures taken by him and his subordinates to trace the alleged detenu. These measures include searching at various places in Kurnool district and boarder areas for tracing the missing man, examining the call data of the mobile phone of the alleged detenu, and also interrogation of respondent No.5 and two other suspects etc. It is further stated in the counter affidavit that the police are making strenuous efforts to trace the missing man and the same are still continuing. In the light of the averments contained in the counter affidavit, as referred to above, we are convinced that the police have been making every effort to trace the alleged detenu, and therefore, it is not possible to direct them to produce the alleged detenu, whose whereabouts are not traced so far.

CVNR,J & MSKJ,J WP.11014 of 2017 In these facts and circumstances of the case, the Writ Petition is closed.
