THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6600 OF 2015 ORDER:

The petitioner, who is the accused, in Crime No.112 of 2015 of Wanaparthy Police Station, Mahabubnagar District, registered for the offences under Sections 341 and 326 read with Section 34 IPC, filed this petition under Section 438 of Code of Criminal Procedure (Cr.P.C.,) seeking anticipatory bail.

Heard and perused the material on record.

The allegation against the petitioner is that he attacked the complainant's father and beat with stick on his right hand, left leg and head by having previous grudges in mine, due to which the complainant's father sustained grievous injuries.

The Court of Special Sessions Judge, Wanaparthy, dismissed the petition filed by the petitioner seeking anticipatory bail, with a direction to the petitioner to surrender before the Court of Judicial First Class Magistrate, Wanaparthy within ten days from that date and to seek regular bail.

On perusing the order passed by the Court of Sessions and on hearing the learned counsel for the petitioner, this Court is also of the view that the petitioner can surrender before the Court concerned and file bail application and the trial Court is directed to consider the bail application on the same day and pass appropriate orders.
