And M/s.Kapil Chits (Hyderabad) Pvt.Ltd., and others

...Respondents

Counsel for the petitioner: Sri J.Mallikarjun Counsel for the respondent: ---- The Court made the following:

ORDER:

This civil revision petition is filed against order, dated 17.12.2014, passed by the Principal Secretary to Government, Revenue (Regn.II) Department, Government of Telangana, under the provisions of the Chit Fund Act, 1982 (for short 'the Act'). At the hearing, the learned counsel for the petitioner has conceded that the Act does not provide for the remedy of revision to this Court.

The petitioner has filed this revision petition under Section 115 CPC. A revision petition under the said provision is maintainable against any decision made or passed by any Court subordinate to the High Court and in respect of which no appeal lies. The State Government exercising its statutory powers under the Act does not answer description of 'Court subordinate to the High Court' under Section 115 CPC. Therefore, this revision petition is not maintainable and the same is accordingly dismissed as such with liberty to the

petitioner to avail any other remedy available to him in law. As a sequel to dismissal of the civil revision petition, C.R.P.M.P.No.303 of 2015 shall stand disposed of as infructuous. C.V.NAGARJUNA REDDY, J 13th February, 2015 VGB
