HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.19453, 20825 and 21290 of 2011 COMMON ORDER:

1. These three Writ Petitions are being disposed of by this common order as they involve similar point for consideration by this Court.

2. The petitioners are running multiplex cinema theatres in Hyderabad city. They submitted a representation on 13.06.2011 seeking permission of the Government to allow online ticket booking system for their multiplex cinema theatres. However, their representation was not considered on the ground that the order of status quo passed by this Court in a batch of cases in W.P.Nos.4430, 5474, 6086, 6565 of 2009; 19020, 20357 and 25403 of 2011 is operating.

3. Now, the learned Counsel for the petitioners submits that the said W.P.No.4430 of 2009 and other Writ Petitions were disposed of by this Court on 27.02.2012 setting aside G.O.Ms.No.110, Home (General-A) Department, dated 19.02.2009 as violative of Article 14 of the Constitution and Sections 4 and 5 of the A.P. Cinemas (Regulation) Act, 1955 and Rules 13 (1) and 17-A of the Rules. The learned Counsel for the petitioners further submits that though Writ Appeals are preferred against the said judgment dated 27.02.2012, no interim order is operating.

4. G.O.Ms.No.110 dated 19.02.2009 had accorded permission to one agency to operate the on-line ticket booking system in the State for a period of ten years.

5. In the circumstances, the impugned order dated 28.06.2011 is set aside and the matter is remanded to the 1st respondent for consideration of the representation of the petitioners dated 13.06.2011 in accordance with law and for passing appropriate orders thereon.

6. The Writ Petitions are allowed to the extent indicated above. No order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
