The petitioners, who are A-1 and A-2 in Crime No.65 of 2015-16 of Prohibition and Excise Station, Vikarabad, Ranga Reddy District, registered for the offence punishable under Section 27 (i) of the A.P. Excise Act, moved this application for anticipatory bail.

The case of the prosecution is that on 06.05.2015 at about 6.30 P.M. the State Task Force, Hyderabad, inspected the toddy depot of TCS, Vikarabad and found 30 plastic crates, each containing 12 bottles of 650 ML of toddy and on analysis, it was found that the toddy is adulterated with Alprazolam. It is also alleged that the petitioners were found in possession of 14.500 K.Gs of suspected substance. Learned Counsel for the petitioners submitted that the petitioners have not committed any offence and they have been falsely implicated in the case and that they are permanent residents of Nizamabad and Rangareddy District. Learned Public Prosecutor submitted that in view of the report of the Government Chemical Examiner, section of law has to be altered into 8 © read with Section 22 of the N.D.P.S.

Act, 1985 and 37 (a) of the Excise Act, 1968 and to that effect the Excise police filed a memo into the trial Court.
