This Criminal Petition is filed by the Petitioners/ accused
Nos.1 to 3 under Section 482 Cr.P.C seeking to quash the Crime No.77 of 2015 of Kodimial Police Station, Karimanagar District, registered for the offence under Sections 323 IPC and Sections 3 (i) (x) of SC/ ST (POA) Act.
2) Heard learned counsel for the petitioners/ accused Nos.1 to 3 and 1st respondent-State represented by learned Public Prosecutor before admission and before ordering notice to 2nd respondent-de facto complainant. Perused the material on record.
3) A perusal of the material shows the investigation is going on. However, from the reading of the report as contended by the learned counsel for petitioners besides there is a partnership business for rice mill or any previous dispute, the report falls only outcome and apart from that there is nothing to say the alleged abuse or insult is in public view in the presence of anybody.
4) Having regard to the above, the petitioners/ accused Nos. 1 to 3 are entitled to concession of regular bail, thereby the application is disposed of giving liberty to petitioners to surrender themselves before the learned Special Judge and move for regular bail with notice to Special public prosecutor concerned and in such event, the learned Special Judge shall grant bail with necessary conditions on the same day. Needless to say, at post bail stage, pending investigation their presence before the Court concerned can be dispensed with. Further remedy is left open to them, in the event of police after filing final report and after taking cognizance by the learned Magistrate.
5 ) Miscellaneous petitions, if any pending, shall stand closed.
