Heard.

Against the trial Court's conviction judgment in C.C.No.609 of 2010 unsuccessfully appealed in Crl.A.No.1018 of 2015 having maintained the present revision pending since 2016, it is out come of Crime No.417 of 2010 of Station House Officer, Hayathnagar Police Station.

The de facto complainant and the accused having present, filed I.A.No.2 of 2019 seeking permission of the Court with leave to compound and to consider the compromise petition. 4.

Heard learned counsel for the accused and the de facto complainant.

Learned Public Prosecutor, representing the State, who submitted that as nearly 10 years taken the valuable time of the police for investigation and of the two Courts below, some compensation to be awarded either to the Army Welfare Fund or to the State if at all to permit compounding.

There is force in the said submission of the learned Public Prosecutor.

Having regard to the above, subject to payment of Rs.90,000/- (Rupees ninety thousand only) to the Army Welfare Fund, the petition

can be allowed from hearing both sides. Since paid, vide memo, dated 08.04.2019, I.A.No.2 of 2019 is allowed. 8.

Consequently, the revision is allowed setting aside the conviction imposed by the trial Court and the accused is acquitted. The bail bonds, if any, of the accused shall stand cancelled. There is no further order as to the refund of fine already paid to the State. Miscellaneous petitions pending, if any, shall stand closed. ____________________________ Dr. B.
