THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38098 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the inaction on the part of the 3rd respondent in submitting the proposals for constitution of the New Managing Committee of Noor-E-Jahan Urdu Ghar-Cum-Shaddi Khana, Kadapa, Y.S.R. Kadapa District, in pursuance of the Letter No.156/B/M.W.D./2014, dated 19.10.2016, addressed by the 2nd respondent, as illegal and arbitrary.

Heard and perused the material available on record. The case of the petitioner is that in pursuance of G.O.Ms.No.162, Minority Welfare (M.F.C) Department, dated 09.07.1999, the 2nd respondent constituted a committee for management and maintenance of Noor-E-Jahan Urdu Ghar-cumShaadi Khana, Kadapa, Y.S.R. District, through the proceedings, dated 12.11.2014, nominating the petitioner as one of the member of the committee and the 3rd respondent as Convenor of the committee. As the period of the managing committee is going to expire on 11.11.2016, the 2nd respondent addressed letter, dated 19.10.2016, calling upon the 3rd respondent to send the proposals for management of new management committee in consultation with minority elders as per G.O.Ms.No.162, dated 09.07.1999. The main grievance of the petitioner is that even though, 14 days time is elapsed after receipt of the letter, dated 19.10.2016, the 3rd respondent has not send the proposals and that the 3rd respondent, in collusion with certain vested interests, being a convenor of Noor-E-Jahan Urdu Ghar-Cum-Shaadi Khana,

Kadapa, Y.S.R. Kadapa District, is not forwarding the proposals as has been requested by the 2nd respondent.

Learned Government Pleader for Revenue for respondents 2 & 3 submitted that the 3rd respondent has already sent representations to the committee for its recommendation and on receipt of the recommendation, the 2nd respondent will decide the issue and the same will be communicated to the petitioner. Considering the facts and circumstances of the case and the submissions made by the learned Government Pleader for Revenue, the Writ Petition is disposed of by directing the 2nd respondent to take appropriate action on the recommendation sent by the committee and decide the issue within a period of three (3) months from the date of receipt of a copy of this order and communicate the same to the petitioner.

Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 14th November, 2016 KL
