O r d e r :

This Contempt Case is filed alleging wilful disobedience of Order, dated 27-08-2013, in WP.No.25079 of 2013, by the respondents.

The petitioner herein has filed the abovementioned Writ Petition seeking to quash Proceeding No.B/1756/2008, dated 29-06-2013, of respondent No.3. Under the said proceeding, respondent No.3 has ordered resumption of the land admeasuring

Ac.1-11 guntas in Survey No.180 of Pregnapur Village in exchange of the land admeasuring Acs.200 guntas in Survey No.385/2, for construction of a school building on the ground that the said land was sold in violation of the provisions of the Andhra Pradesh Assigned Lands (Prohibition of Transfers) Act, 1977. This Court has allowed the said Writ Petition and quashed the Proceeding impugned therein vide Order, dated 27-08-2013.

In the present Contempt Case, the grievance of the petitioner is that despite the said order, the land admeasuring Acs.2-00 guntas, which was proposed to be given in exchange of the land admeasuring Ac.1-11 guntas, has not yet been handed over to her.

In my opinion, in the absence of any relief claimed by the petitioner for a direction to the respondents to hand over the land admeasuring Acs.2-00 guntas, in lieu of resumption of the land admeasuring Ac.1-11 guntas, which was quashed by this Court, much less a direction issued by this Court in this regard, non-handing over the land admeasuring Acs.2-00 guntas to the petitioner

cannot be said to have constituted contempt. If the petitioner feels aggrieved by the inaction of the respondents in handing over the said extent of Acs.2-00 guntas of land, she shall be free to avail appropriate remedy in accordance with law.

Subject to the liberty given to the petitioner as above, the Contempt Case is dismissed.
