THE HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CIVIL REVISION PETITION No. 3746 OF 2016 ORDER:
Heard Sri S.Madan Mohan Rao, learned counsel for revision petitioners and Sri Kowturu Vinaya Kumar, learned counsel for respondents-caveator.
2. The Civil Revision Petition is filed by the revision petitioners, who are respondents, against the order passed in I.A. No.182 of 2016 in O.S. No.142 of 2016 dated 28.04.2016 by the learned Sub-Divisional Magistrate and Special Assistant Agent to Government, Mobile Court, Bhadrachalam, Khammam District, wherein the learned Magistrate passed an exparte injunction against the revision petitioners.
3. In view of the fact that the impugned order is exparte order, this Court feels that it is apposite to direct the revision petitioners to approach the trial Court and file their counter in I.A. No.182 of 2016 before the trial Court.
4. Accordingly, the civil revision petition is disposed of at the stage of admission and the revision petitioners are directed to file their counter in I.A. No.182 of 2016 within seven (7) days from the date of this order, in which case, the trial Court shall dispose of I.A No.182 of 2016 on merits after hearing both sides, within twenty (20) days from the date of filing counter.
5. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
