HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.35384 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the respondents in trying to dispossess from the agricultural land in R.S.Nos. 2/ 2, 3, 13, 14, 15/ 2 to an extent of Ac.2.29 cents, Ac.1.20 cents, Ac.1.18 cents, Ac.5.32 cents and Ac.5.48 cents respectively, situated at Sunkollu Village, Nuzvid Mandal, Krishna District, without issuing any notice and without initiating any proceedings under law, as illegal, arbitrary and violative of principles of natural justice. 2) At the time when the matter is taken up for hearing, the Government Pleader for Revenue (AP), placed on record the written instructions received by him, which shows that the Government has proposed for issuance of house site pattas to the beneficiaries of Sugali (ST) caste people in R.S.No.2/ 1 to an extent of Ac.10.
00 and they are trying to prepare the sub-division record. Since the said land which is adjacent to the petitioner's land, he apprehends that there would be interference with his property. But the Tahsildar categorically states that they are not interfering with the property which is in possession of the petitioner, they will entering into the land only to fix boundaries in the government land.
3) Having regard to the above, the Tahsildar or any other Government Officer shall not interfere with the subject property except in accordance with the procedure established under law. 4) With the above direction, the writ petition is disposed of.
