THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.18437 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed to declare the action of respondents in obtaining finger prints and palm prints on the blank papers as illegal and arbitrary and to direct the respondents not to open a rowdy sheet against the petitioner vide Crime No.387 of 2015, on the file of the II Town Police Station, Rajahmundry, East Godavari District.
The case of the petitioner is that the 3rd respondent foisted a false case against the petitioner under Sections 3 & 4 of APGA, Section 66-A of the ITA 2000-2008, which was registered as FIR No.387 of 2015, dated 09.12.2015, stating that the petitioner was involved in illegal cricket betting through cell phone by watching cricket match on the television. On 06.06.2016, the police belonging to the 3rd respondent approached the petitioner stating that on the direction of their superiors, they are interested in opening Rowdy Sheet against the petitioner and they had taken his finger prints and palm prints on various blank papers. Aggrieved by the same, the present writ petition is filed by the petitioner.
Considering the grievance of the petitioner, the petitioner is directed to make a representation to the Superintendent of Police, East Godavari District at Kakinada (2nd respondent) on or before 05.11.2016 informing that he is not involved in any other crime except the crime registered in Crime No.387 of 2015, but the 3rd respondent recommended for opening of a rowdy sheet against the petitioner. On such representation, the 2nd respondent is directed to consider and dispose of the same, in accordance with law, as expeditiously as possible, within a period of one (1) month from the date of receipt of a copy of this order.
Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ____________________ RAJA ELANGO,J Date: 20th October, 2016 KL
