Heard Sri S.D. Gowd, learned counsel appearing for the petitioner and Sri Aravala Rama Rao, learned Standing Counsel for the respondents-APSRTC.
2. The petitioner was appointed as a driver in the respondentsCorporation in the year 1997. While so, he was declared unfit for the post of driver due to defective vision by the Senior Medical Officer, APSRTC Hospital, Tarnaka, Hyderabad on 03-11-2011. The learned counsel appearing for the petitioner submits that since then, though the petitioner has been making several representations for providing him alternative employment, the respondents-Corporation has not been taking any action.
3. On the other hand, the learned Standing Counsel for the respondents-Corporation would submit that the petitioner was directed to undergo medical examination for the purpose of suitability to the alternative post, but the petitioner did not attend the medical examination.
4. Under these circumstances, the writ petition is disposed of directing the respondents-Corporation to subject the petitioner for medical examination and basing on the medical certificate obtained thereafter, provide him suitable alternative post in terms of Section 47 of the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, within a period of eight
weeks thereafter. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
