Venkatesh , Tirumani Veera Venkateshwara Rao v. The State Of Telangana
SMT JUSTI CE T. RAJANI CRI MI NAL PETI TI ON No.1 0 4 3 5 2 0 1 8 ORDER:
This petition is filed seeking for grant of anticipatory bail to the petitioner, who is the accused, in Crime No.735 of 2018 on the file of the Station House Officer, Banjara Hills Police Station, Hyderabad. The offences alleged are under Sections 493 and 420 IPC.
2.
Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.
3.
As per the averments in the complaint, the petitioner and the victim developed relationship and they were living together. The allegation is that the victim came to know that the petitioner had relationship with other women. But even after that they were living together. It appears that the victim was abused and beaten on questioning the accused about his relationship with other women.
4.
But, the learned Public Prosecutor submits that the victim has attempted to commit suicide on two occasions and that the petitioner has been absconding since registration of the crime and that he is threatening the witnesses.
5.
Hence, in view of the above, this Court opines that this is not a fit case to grant bail to the petitioner. 6.
However, the counsel for the petitioner seeks an order from this court to give a direction to the lower court to dispose
of the bail application, that would be filed by him, on the same day.
Hence, considering the above, the Criminal Petition is dismissed. The court below shall dispose of the bail application, if any filed, expeditiously, preferably on the same day, subject to the pressure of other work. As a sequel, the miscellaneous applications, if any pending, shall stand closed. _ _ _ _ _ _ _ _ _ _ T. RAJANI , J October 10, 2018 LMV
