THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.230 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-A16 under Section 438 Cr.P.C. seeking to grant anticipatory bail to him in Crime No.157 of 2015 on the file of Allagadda Town Police Station, Kurnool District, registered for the offence punishable under Sections 147, 148, 307, 324, and 302 r/w 149 IPC.

It is alleged that on 14.10.2015 while the deceased was going to home from Allagadda Town in Innova vehicle, A1 to A11 and two others dashed the said Innova with Tipper and dragged the vehicle for some distance and thereafter, some of the accused sprinkled red chilly powder on the deceased and others and A1 to A3 hacked the deceased with a sickle and dagger. They have also inflicted injuries to the driver. The motive attributed in the complaint is that the deceased committed the murder of the parents and brother of A1. It is stated that L.W.12 was examined on 16.10.2016 and he informed about the conspiracy made in the presence of A1 and the petitioner herein.

Considering the circumstances of the case, this Court is of the view that grant of anticipatory bail to the petitioner will cause prejudice to the investigating agency.

Accordingly, the Criminal Petition is dismissed. However, the petitioner is at liberty to surrender before the Court concerned and move an application for regular bail.
