ORDER
This writ petition is filed seeking the following relief: ".....to issue a writ of mandamus or any other appropriate writ order or direction declaring (1) inspection conducted by the officials of the 1st respondent on 10.08.2013 in respect of LT service connection bearing R1000149, Category LT-II(B) Non-domestic/Commercial of Hyderabad in Moghalpura Section situated at Municipal No.22-5-303, Fatheualla Baig Lane, KaliKaman, Hyderabad, consequently as per Clause 10 of GTCS is as illegal, unauthorized being violative of the Electricity Act, 2003 (ii) clause No.7.4.1, 7.5.2, 10.2.1 of the general terms and conditions of supply of the 1st respondent as highly illegal, arbitrary and irrational, being contrary to Section 154(2) of Electricity Act, 2003 and (iii) consequently set aside the provisional assessment notice letter No.
Ade/op/Charminar/D.No.902, dated 12.08.2013 of the 2nd respondent and pass such other order orders as this Hon'ble Court deems fit and proper under the circumstances of the case."
This Court, while ordering notice before admission, granted interim direction subject to condition that the petitioner deposits 50% of the demanded amount by the respondents.
In spite of the matter being listed under the caption "for dismissal", none appeared for the petitioner.
Learned Standing Counsel appearing for the respondents contended that in pursuance of the interim order granted by this Court on 5.2.2014, the petitioner has already deposited 50% of the demanded amount and that the matter may be referred to the Special Court for final assessment of pilferage amount.
In view of the same, the Writ Petition is disposed of directing the respondents to refer the matter to the Special Court for final assessment of pilferage amount. No costs. Miscellaneous petitions, if any, pending, shall stand closed.
