As per the proceeding sheet, at the request of the learned Counsel for the petitioner, this petition was adjourned from 21.9.2017 to list after Dasara vacation. On 4.10.2017 when the matter was called, there was no representation for the petitioner. Hence, in the interest of justice, the matter was adjourned to this day in order to post it under the caption of "for dismissal". In spite of posting the matter under the caption of "dismissal", none appeared on behalf of the petitioners, and there is no representation for the petitioners. The above facts clearly go to suggest that the petitioner is not acting diligently and he has no interest to prosecute this petition.

Hence, the Criminal Petition is dismissed for non-prosecution. Consequently, interim stay granted on 28.6.2011 in Crl.P.M.P.No.5164 of 2011 is vacated and the miscellaneous petitions pending, if any, shall stand closed.
