THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33438 of 2015 ORDER:

This writ petition was filed laying a challenge to FIR.No.52 of 2008 on the file of the I Town Police Station, Ongole, Prakasam District. However, written instructions dated 27.10.2015 were furnished by the SubInspector of Police, I Town Police Station, Ongole, Prakasam District, stating that upon investigation in Crime No.52 of 2008, which was registered under Sections 307, 313, 376 and 498-A I.P.C. read with Section 34 I.P.C., a charge sheet was laid before the learned II Additional Munsif Magistrate, Ongole. It is further stated that the petitioner herein was arrayed as accused No.2 therein and that except for him, all the other accused were arrested. The said charge sheet was stated to have been returned by the Court for compliance with certain objections and thereupon it was filed on 01.04.2015 and the PRC number was awaited.

In the light of the afore-stated developments, the challenge in this writ petition to the FIR no longer survives for consideration. The writ petition is accordingly dismissed leaving it open to the petitioner to pursue appropriate remedies in accordance with law. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
