HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5507 of 2015 ORDER :

This Criminal Petition is filed by the Petitioner/Accused under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.330 of 2015 of Jeedimetla Police Station, Cyberabad, registered for the offences punishable under Section 509 IPC and Section 3 (i) (x) of SC, ST of (POA) Act, 1989.

2) Heard learned counsel for petitioner/ accused as well as learned public prosecutor representing 1st respondent-State before admission and before ordering notice to 2nd respondentde facto complainant. Perused the material on record.

3) There is force in the contention of the learned counsel for the petitioner from the perusal of the report dated 06.04.2015, which is lengthy report of more than one page bereft of particulars any intentional insult on acts in a public view much less using any words or place where occurred.

4) Having regard to the above, the petitioner is entitled to the concession of bail, thereby the Criminal Petitioner is disposed of, giving liberty to petitioner to surrender himself the Special Judge concerned and move for regular bail with notice to Assistant public prosecutor concerned, in such event the learned Special Judge shall grant bail on the same day with necessary conditions. Further remedy is left open to the petitioner in the event of after police filing final report and after taken cognizance by the learned Magistrate. Needless to say pending investigation, the presence of the petitioner before the Court can be dispensed

with.

5) Miscellaneous petitions, if any pending, shall stand closed.
