HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 19164 of 2016 ORDER:
The complaint of the petitioner, who is the Sarpanch of Narasarajupalem Village and Grampanchayat, Maripudi Mandal, is that various works under the schemes notified in terms of G.O.Ms.No.34, Water Resources (CAD) Department, dated 02.03.2016 and G.O.Ms.No.70, Irrigation & CAD (WRG-GRC) Department, dated 04.12.2014, are being executed/shown as executed without therebeing execution of the work, without following the procedure, and thereby, the funds are being misutilised. The petitioner made a representation to the District Collector, Prakasam, on 30.05.2016.
Heard Sri T. Niranjan, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and learned Government Pleader for Irrigation (A.P).
In the writ affidavit, the petitioner has set out several details. It is not necessary for this Court to refer to those writ averments. The representation, which has been made by the petitioner, is a short representation. What all it says is that the petitioner has been elected as Sarpanch and the ruling party politicians have got sanctioned some works under the "Neeru-Chettu" scheme, started the works without giving any information to him, and threatening him. Therefore, he prays to take action in accordance with the afore stated Government Orders. The representation hardly serves as a source of any information or a complaint in relation to the averments made in the writ affidavit.
The sum and substance of the arguments of the learned counsel for the petitioner is that without following the procedure and in violation of the norms notified in various Government Orders, the works are being executed/being shown as executed and in some cases, without executing any works, money is being drawn and thereby, the funds are being misutilised at large scale. At this stage, it may be apt to mention that a large number of cases of this nature are coming before this Court, particularly, from Prakasam District.
Considering these aspects, this writ petition is disposed of directing
the District Collector, Prakasam District, who is notified as Chairman at District/Regional Level under G.O.Ms.No.70 dated 04.12.2014, to take necessary steps and lay down clear guidelines with respect to receiving of the complaints and redressal of the same, so that the money that is allocated to the respective villages is utilized properly. It is needless to mention that the petitioner shall be at liberty to submit a detailed representation to the District Collector, Prakasam, setting out the averments as detailed in the writ affidavit. Consequently, the miscellaneous applications, if any, shall also stand closed. No order as to costs.
