HON'BLE SRI JUSTICE R. SUBHASH REDDY Civil Revision Petition No.4450 of 2014 Order:

This Civil Revision Petition, under Article 227 of the Constitution of India, is filed by defendant No.2 in O.S.No.45 of 2006 on the file of the Junior Civil Judge, Gannavaram, aggrieved by the order dated 10.11.2014 passed in I.A.No.191 of 2014 therein. The suit, which is of the year 2006, was coming for cross-examination of P.W.1. At that stage, petitioner-defendant No.2, who has come on record, has filed I.A.No.191 of 2014 seeking permission to file additional written statement, which is dismissed by the trial court by the impugned order.

Heard learned counsel for the petitioner, learned counsel for the respondent, perused the impugned order and the affidavit filed in support of I.A.No.191 of 2014.

Except stating that some documents were traced out recently, no other valid reason is stated in the affidavit filed in support of the I.A., for seeking permission to file additional written statement. The suit is of the year 2006 and written statements are already filed. If there are any documents which support the case of the petitioner-defendant No.2, it is always open for her to file the same, but, at the same time, there is no reason to file additional written statement, without indicating any valid reason.

For the aforesaid reasons, the Civil Revision Petition is dismissed.

No order as to costs.

However, if there are any documents, which are relevant for the purpose of adjudication of the issues in the suit, it is open to the petitioner-defendant No.2 to take steps in accordance with law.

As a sequel, miscellaneous petitions if any pending in the C.R.P., stand closed.
