HON'BLE SRI JUSTICE S.V. BHATT Writ Petition No.18306 of 2017 ORDER:

The petitioner challenges the order of the 4th respondent passed in Rc.B/ 435/ 2016 dated 15.03.2017 under A.P. Rights in Land and Pattadar Pass Book Act, 1971.

2. Admittedly, the order challenged in the writ petition can be assailed by filing appeal before the Revenue Divisional officer. Though, a few circumstances are stated for invoking the jurisdiction of this Court under Article 226 of the Constitution of India, this court is not persuaded by reasons so stated and hence, not inclined to exercise the discretion or jurisdiction under Article 226 of the constitution of India against the order impugned in the writ petition.

3. Hence the petitioner is given four weeks time from today to file appeal before the Revenue Divisional Officer by enclosing a copy of this order. The appeal, if as permitted by this court is filed, the Revenue Divisional Officer/ Appellate Authority, is directed to examine and dispose of the appeal expeditiously.

4. The writ petition is, accordingly, disposed of. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
