O R D E R
(Per Hon'ble Sri Justice Sanjay Kumar) This writ petition was filed assailing the notice of sale dated 23.06.2014 issued by the Andhra Bank proposing to hold the auction of the secured asset on 28.07.2014.
Sri A.Krishnam Raju, learned counsel for the Andhra Bank, would state that the aforestated sale did not materialize for want of bidders and that the petitioners also did not comply with the conditional order granted by this Court. He would further state that owing to this failure on the part of the petitioners, a fresh sale was conducted thereafter and the same is the subject matter of a fresh writ petition filed before this Court.
This being the position, we find no reason to adjudicate the present writ petition on merits. The challenge to the auction sale notice dated 23.06.2014 is rendered academic owing to the fact that it did not result in an actual sale.
The writ petition is accordingly dismissed on this ground. All issues are left open. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
