HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2342 OF 2016 ORDER:
This criminal petition is filed, under Section 482 Cr.P.C., by the petitioner to quash the proceedings against the petitioner - A4 in Crime No.71 of 2015 of Sodam Police Station, Chittoor District, registered for the offences punishable under Sections 302 and 306 r/w.34 IPC and subsequently the section of law was altered by adding Section 384 and 420 IPC.
Heard and perused the material available on record. The allegation against the petitioner is that he used to give hand loans on daily interest basis to the deceased and used to harass him to give higher rate of interest, due to which the deceased committed suicide along with his wife and children. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and he never harassed or demanded the deceased with regard to money.
A perusal of the record discloses that on the basis of the suicide note left by the deceased, the case was registered. Earlier, this Court dismissed the anticipatory bail application filed by the petitioner. Therefore, this Court is of the view that this is a matter to be investigated into and this Court is not inclined to interfere with the investigation at this stage.
The Criminal Petition is dismissed. Miscellaneous Petitions pending if any, shall stand closed.
