HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.1961 of 2017 ORDER:

The case of the petitioners is that some of them are Ex-servicemen and serving the Indian Army at present and they were granted pattas to an extent of Ac.5-00 each at Rompilli Village, Anantagiri Mandal, Visakhapatnam District in different survey numbers mentioned in the petition and the said lands formed in to single compact. The petitioners were granted pattadar passbooks and their families are cultivating the same. The respondents disputed the boundaries. Aggrieved by the same, the petitioners filed application before the 4th respondent for conducting survey and fixing the boundaries in the presence of 5th respondent to avoid controversy on 18-10-2016. As no steps are being taken, the present writ petition is filed.

Heard learned counsel for the petitioners and the learned Assistant Government Pleader for Revenue and learned Assistant Government Pleader for Forests. Learned Government Pleader for Forests submits that since adjacent lands are forest lands, notice needs to be given to the 5th respondent or concerned officer having jurisdiction over the area, before any survey is conducted over the subject lands.

Since it is stated that application of the petitioners dated 18-10-2016 is pending before the 4th respondent, the 4th respondent is directed to dispose of the same after issuing notice to the petitioners and affected parties including the 5th respondent and concerned forest officials having jurisdiction over the area and take action for conducting survey within a period of three months from the date of receipt of a copy of this order. Pending survey, status-quo shall be maintained.

With the above direction, this writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. _________________________ A.RAJASHEKER REDDY,J 24-01-2017 Nvl
