HONOURABLE SRI JUSTICE M.S.K. JAISWAL CRIMINAL PETITION No. 12211 of 2016 ORDER:
This Criminal Petition under Section 482 read with Section 451 Cr.P.C. is filed seeking to direct the Station House Officer, Prohibition and Excise Station, Rajahmundry North, East Godavari District to break open the lock of Shop No.D/17 bearing D.No.8-930/4, SVG Market, Vankayalavari Veedhi, Rajahmundry, East Godavari District and to release the 32 gunny bags x 50 Kgs of black jaggery, 62 x 15 Kgs of Black jaggery Dimmas, totaling to 2530 Kgs seized in the aforesaid Crime.
Having heard the learned Counsel on either side and gone through the material papers, it is clear that it is for the petitioner to approach the competent authority seeking release of the seized goods and he cannot directly approach this Court seeking release of the seized goods.
In the circumstances, this Criminal Petition is disposed of giving liberty to the petitioner to approach the competent authority/Deputy Commissioner, Prohibition and Excise seeking release of the seized goods. As and when such petition is filed, the competent authority/Deputy Commissioner, Prohibition and Excise, shall dispose of the same, on merits and in accordance with law, within a period of one week from the date of receipt of the application from the petitioner.
Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. No order as to costs.
