THE HON'BLE SRI JUSTICE M.S. RAMACHANDRA RAO WRIT PETITION No.30632 of 2016 ORDER:

Petitioner's grievance is that the Officials of the 2nd respondent are insisting on petitioner's producing No Objection Certificate from the Revenue Authorities as a condition precedent for consideration of application for Building Permission.

Sri Pasham Krishna Reddy, learned Standing Counsel for 2nd respondent states that in view of the decision of this Court in Hyderabad Potteries Pvt. Ltd. Vs. Collector, Hyderabad District and another1 and State of Andhra Pradesh Vs. Hyderabad Potteries Pvt. Ltd. and another2, the 2nd respondent is not insisting on production of No Objection Certificate and the allegation of the petitioner is false.

In view of the said submission, the Writ Petition is disposed of directing the 2nd respondent to consider petitioner's application for Building Permission in respect of the subject land without insisting on petitioner's producing No Objection Certificate from the Revenue authorities. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
