Heard learned counsel for the petitioner as well as learned Assistant Government Pleader and perused the prayer in the writ petition with the supporting affidavit and also the interim order dated 12.06.2017 passed in W.P. No.18907 of 2017, which was filed by the self same petitioner against the respondents, permitting the petitioner to apply and entertain the bid and directing the respondents to dispose of the representation of the petitioner pending.

2) It is the submission of the learned counsel for the petitioner that the subject matter covered by W.P. No.18907 of 2017 has become infructuous, as the respondents rejected the petitioner's tender by considering the representation dated 04.05.2017 pursuant to the interim order dated 12.06.2017 passed by this Court and issued fresh notice dated 03.07.2017 inviting tenders, which is impugned in Writ Petition No.24436 of 2017.

3) Recording the said submission, W.P. No.18907 of 2017 is dismissed as infructuous.

4) A perusal of the prayer in W.P. No.24436 of 2017 shows that on 03.07.2017 tender notice was issued and the petitioner made a representation dated 18.07.2017 similar to the earlier representation dated 04.05.2017 to reconsider the technical specifications so as to enable it to participate in the bid, but, so far the respondents did not consider the same and the last date for submission of bid is 24.07.2017 i.e., today.

Dr. SSRB,J WP_18907_24436_2017 5) It is the submission of the learned Assistant Government Pleader, from the written instructions, that there is nothing about the rejection of earlier representation much less the present representation dated 18.07.2017, which is pending. 6) Having regard to the above, W.P. No.24436 of 2017 is disposed of directing the petitioner to apply to entertain the bid, however, finalization of the bid is subject to the result of the representation dated 18.07.2017.
