HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35574 of 2016 ORDER:

This writ petition is filed seeking to call for the records pertaining to the F.I.R.No.78 of 2016, dated 10.09.2016, on the file of the 4th respondent, booked at the instance of the 6th respondent in the name of the 5th respondent and quash the same after declaring the same as illegal and arbitrary and consequently to restrain the respondents from arresting the petitioner. Heard and perused the material available on record. The main grievance of the petitioner is that the petitioner is a physically handicapped person with 100% vision disability and that he is an innocent person and is not guilty of any of the offences charged with by the de facto complainant. The case is of civil nature and the petitioner was purposefully implicated into the case with an intention to extort money from him and under the threat of criminal prosecution though he has not committed any type of offence.

Considering the grievance of the petitioner, the 4th respondent is directed to complete the investigation in F.I.R.No.78 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. The petitioner is directed to appear before the 4th respondent as and when required for the purpose of investigation. Accordingly, the Writ Petition is disposed of. No costs.
