THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2537 OF 2016 ORDER:
This petition is filed by the petitioner-A2 under Section 482 Cr.P.C. seeking to quash the proceedings against him in C.C.No.126 of 2014 on the file of the II Additional Judicial First Class Magistrate, Khammam, Khammam District.
Heard and perused the material available on record. It is alleged that the 2nd respondent purchased the land in Sy.Nos.23, 24, 26 and 47 situated at Ballepalli village, Khammam Rural Mandal from one K. Venkaiah and Guravaiah and the petitioner acted as mediator for the said sale transaction. Later, the complainant came to know that the petitioner and A1 influenced the vendors to register the sale deed and the said registration is illegal. Learned Counsel for the petitioner submitted that the petitioner has nothing to do with the said sale transaction and that there is a dispute with regard to the money transaction between the petitioner and A1 and that the 2nd respondent in collusion with A1 foisted the above case.
Considering the facts and circumstances of the case and the allegations made against the petitioner, this Court is not inclined to grant the relief prayed by the petitioner.
At this stage, the learned Counsel for the petitioner prayed for dispensing with the presence of the petitioner before the trial Court. In view of the above submission, the presence of the petitionerA2 before the trial Court is dispensed with except on the dates when his presence is specifically required by the trial Court. The petitioner is directed to be represented through his Counsel before the trial Court on all hearing dates.
Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions pending, if any, shall stand closed.
