HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5849 of 2002 ORDER:

The petitioner in this writ petition, is challenging the charge Memo dated 11.02.2000.

When the matter is taken up for hearing, none appeared for the petitioner.

The Standing Counsel appearing for respondents has contended that the petitioner has contested the Grampanchayat elections without obtaining prior permission and since the petitioner had violated the Conduct Rules, the impugned charge memo was issued. It is submitted that this Court, vide orders dated 02.04.2002, granted interim stay and by virtue of said interlocutory orders, the petitioner is discharging his duties as General Mazdoor, and that the petitioner is going to retire in 2021. 4.

This Court, having considered the aforesaid submission, is of the considered view that it is always open for the petitioner to submit a fresh representation seeking dropping of charges and it is for the respondents to pass appropriate orders. The respondents are directed to take a lenient view since the petitioner is likely to retire in another two years. 5.

Therefore, the writ petition is disposed of, directing the petitioner to submit a fresh representation to the respondents to drop the Charge Memo dated 11.02.2000 and upon such representation being received, the respondents shall consider the same and pass appropriate orders in

AKS, J W.P.No.5849 of 2002 accordance with law, duly keeping in view the observations made by this Court supra. No order as to costs.
