THE HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.28365 of 2013 ORDER:

Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the 1st respondent Corporation. 2.

The prayer sought in the writ petition is as under:- "...to issue an appropriate writ more particularly one in the nature of writ of mandamus declaring the action of the respondents in not processing the application dated 3.9.2012 seeking trade license for running Bar and Restaurant in premises No.8-3-833/231, Kamalapuri Colony, Hyderabad, as illegal, arbitrary, contrary to the provisions of Greater Hyderabad Municipal Corporation Act and Zoning Regulations and also violative of principles of natural justice and consequently direct the respondents to process the application dated 3.9.2012 and issue trade license in favour of petitioner and to pass such other or orders as this Hon'ble Court deems fit and proper in the circumstances of the case." 3.

During the course of hearing, learned Standing Counsel informs the Court that except filing the application, dated 03.09.2012, seeking trade license for running Bar and Restaurant in the premises bearing No.8-3-833/231 at Kamalapuri Colony, Hyderabad, the petitioner has not enclosed the relevant documents required for grant of trade license. 4.

In view of the above, the writ petition as filed is premature in nature.

Accordingly, the writ petition is closed. However, liberty is given to the petitioner to submit all the required documents for grant of trade license before the 1st respondent Corporation seeking appropriate orders. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
