THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION Nos.5346, 5888, 5889, 5890 and 5891 OF 2016 COMMON ORDER:

The criminal petitions are filed under Section 438 of the Code of Criminal Procedure by the petitioners/accused seeking grant of anticipatory bail in connection with crime No.82 of 2016 on the file of the Posta P.S., (ARS Detective Department, Lalbazar Street, Kolkata), registered for the offences under Sections 120-B, 307, 302 and 427 IPC.

Heard and perused the records.

Learned senior counsel for the petitioners submits that the petitioners moved the criminal petitions seeking anticipatory bail before the Vacation Court and the Vacation Court granted pre-arrest bail directing the second respondent to release the petitioners in the event of their arrest before 03.06.2016 on each of their executing a personal bond for a sum of Rs.1,00,000/- (Rupees one lakh only) with two sureties for a likesum each to the satisfaction of the Inspector of Police, Anti Rowdy Section, Detective Department, Lalbazar Street, Kolkata. The learned senior counsel further submits that the said order may be extended for one month to enable the petitioners to approach the Court concerned at Kolkata seeking anticipatory bail. Admittedly, the cases are pending before the Additional Chief Metropolitan Magistrate, Kolkata.

The petitioners are residents of Hyderabad and as such, they have moved the petitions before this Court seeking anticipatory bail. Considering the facts and circumstances of the case and also considering the fact that the petitioners cooperated with the investigating agency, as per the interim order of this Court, the petitioners are granted further time for a period of four weeks, i.e., upto 07.07.2016, to enable them to approach the Court concerned in Kolkata jurisdiction seeking anticipatory bail. It is made clear that if the petitioners fail to approach the Court concerned in the jurisdiction of Kolkata on or before 07.07.2016, the interim bail granted in favour of the petitioners shall stand vacated. The Criminal Petitions are accordingly disposed of.

Miscellaneous petitions, if any pending in the criminal petitions shall stand closed. _____________________ JUSTICE RAJA ELANGO 07.06.
