It is a case where the petitioner seeks Writ of Mandamus alleging that the application made by her on 22.07.2018 for construction of building has not been considered.
A counter affidavit is filed by the respondent-Municipality stating that the petitioner's application was rejected on 24.09.2018 itself and the same was also uploaded on the web portal and the shortfall intimation letter was also sent to the petitioner on 27.10.2018.
Having regard to the shortfall intimation which has already been sent to the petitioner, the relief which is claimed in the writ petition virtually stands granted, inasmuch as the shortfall intimation has already been sent intimating as to why her application was not considered for granting permission.
In the circumstances, the writ petition is disposed of by giving liberty to the petitioner to approach the respondents with a fresh application for permission by fulfilling the requirements and clearing the defects, if any, as stated in the shortfall intimation letter, and on such application the same shall be considered by the respondent authorities as expeditiously as possible, at any rate, within four weeks from the date of making application. No costs. Miscellaneous petitions, if any pending, shall stand closed.
