THE HON'BLE SRI JUSTI CE A.V.SESHA SAI WRI T PETI TI ON No.5817 of 2017 O R D E R:

The order of suspension passed by the Revenue Divisional Officer, Gurazala, Guntur District vide R.C.No.767/2016-C, dated 19.12.2016, is under challenge in the present writ petition. By virtue of the order under challenge the Revenue Divisional Officer suspended the authorisation of the petitioner herein pending enquiry.

2.

It is submitted by the learned counsel for the petitioner that the order of suspension passed by the Revenue Divisional Officer is highly illegal, arbitrary and unwarranted in the facts and circumstances of the case and in view of minor variation as indicated in the impugned proceedings. 3.

On the other hand, it is submitted by the learned Government Pleader that since the variation is on higher side and as the enquiry is pending before the Revenue Divisional Officer, the present writ petition is not maintainable and the petitioner herein needs to face the enquiry. 5.

In the present case, the enquiry is pending before the Revenue Divisional Officer, Gurazala, Guntur District. In view of the above submissions, the Revenue Divisional Officer, Gurazala, Guntur District, is directed to complete the enquiry pursuant to the impugned orders in R.C.No.767/2016-C, dated 19.12.2016 and pass final orders within a period of eight (8) weeks from the date of receipt of this order. 6.

With the above observation, the writ petition stands disposed of. As a sequel, miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
