THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.507 OF 2016 ORDER:

This Criminal Petition is filed by the petitioners-accused Nos.1 to 3 under Section 438 Cr.P.C. seeking to grant anticipatory bail to them in Crime No.7 of 2014 on the fie of Sydapuram Police Station, SPSR Nellore District, registered for the offences punishable under Sections 290 and 323 IPC and 3 (1) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Heard and perused the material available on record. The case of the prosecution is that when the petitioners tried to dug a borewell near burial ground of Aurndatiyawada, where the de facto complainant is residing, the de facto complainant and others complained the same to the Tahsildar, who inturn directed the VRO to conduct enquiry. Having come to know the same, the petitioners abused the de facto complainant in the name of his caste and threatened him with dire consequences.

Though the allegations are no so serious in nature, there is a bar for grant of bail for the above said offence. Therefore, considering the facts and circumstances of the case, this Court is inclined to pass the following order:

The petitioners-accused Nos.1 to 3 are directed to surrender before the Magistrate concerned and file an application to grant bail and on such application being filed, the Magistrate concerned is directed to consider the same on the same day and release the petitioners on their executing personal bond for Rs.5,000/- (Rupees Five Thousand only) each with one surety for the like sum each to the satisfaction of the said Magistrate.
